Refund Policy

Thank you for choosing Peninsula Fishing Kayak Rentals. We aim to provide safe, enjoyable kayaking experiences on the Peninsula. This Refund Policy outlines when and how refunds, credits, or rescheduling apply. It is designed to comply with the Australian Consumer Law (ACL) and local maritime safety considerations.
By making a booking with us, you agree to this policy.
Australian Consumer Law (ACL)
Your rights under the ACL apply in addition to this policy. You are entitled to a remedy (repair, replacement, resupply, or refund) for major failures and for other reasonably foreseeable loss or damage. If a service has a minor problem, we will remedy it within a reasonable time (e.g., resupply or credit). Nothing in this policy limits your statutory rights.
Definitions

Booking: A confirmed reservation with payment for kayak rental and any add-ons (e.g., fishing gear, tackle, roof racks, delivery).

Start Time: The scheduled pickup or delivery time stated in your booking.

Weather/Safety Closure: A closure initiated by us due to unsafe conditions (e.g., strong winds, swell, lightning, poor visibility) or government advisories.

No‑Show: Failing to arrive within 30 minutes of the Start Time without notice.
Cancellations by You

Before 72 hours before your start time:

Option A: 100% refund to original payment method (less any non-refundable third‑party payment processing fees, if applicable).

Option B: Reschedule your booking.

Between 72 hours and 24 hours before your start time:

Option A: 75% refund to original payment method (less any non-refundable third‑party payment processing fees, if applicable).

Option B: Reschedule your booking.

Less than 24 hours before your start time:

Option A: 50% refund to original payment method (less any non-refundable third‑party payment processing fees, if applicable).

No‑Show:

No refund.

Early Return / Change of Mind after Start Time:

No refund for unused time or equipment unless agreed.

Weather, Safety, and Operational Cancellations
Your safety is our priority.

If we cancel or suspend a booking due to Weather/Safety Closure or operational issues (e.g., equipment failure, staff illness):

You may choose a full refund, or a free reschedule of equal value.

We rely on BOM forecasts, local conditions, and maritime safety guidance. We reserve sole discretion to determine unsafe conditions.
Late Arrival

More than 30 minutes late: Treated as a No‑Show, unless you have contacted us and we confirm a revised Start Time.
Equipment Condition, Loss, and Damage

Pre‑hire inspection: You’ll be briefed and asked to confirm kayak and gear are provided in good order.

Post‑hire inspection: Charges may apply for loss, damage, excessive cleaning, or missing items, per our fee schedule.

If equipment failure not caused by misuse prevents you from reasonably enjoying the hire:

Choose a pro‑rated refund or credit for the unused portion, plus resupply where practicable.

Damage, loss, or contamination due to negligence, prohibited use, or breach of safety instructions are not grounds for refund.
Multi‑Day Hires and Packages

Cancellation terms apply to the Start Time of Day 1.

Once commenced, refunds are only available for:

Weather/Safety Closure directed by us; or

Major failure under the ACL.

For partial days lost due to our decision or major failure, we will provide a pro‑rated refund or credit.
Third‑Party Vouchers and Marketplaces

If you booked via a third‑party platform, their refund terms may apply. We will assist within the constraints of that platform.

Gift vouchers issued by Peninsula Fishing Kayak Rentals are non‑refundable but are transferable and valid for 1 year from issue, unless otherwise stated by law.
Group Bookings and Events (More than 2 kayaks)

3+ days’ notice: Full refund.

1-3 days’ notice: 50% refund.

Less than 24 hours before your start time: No refund.

Custom logistics (delivery permits, special equipment) may be non‑refundable once committed.
Health, Fitness, and Eligibility

You must meet minimum safety criteria (e.g., ability to swim 50m unaided, not under the influence of alcohol/drugs, adhere to PFD requirements).

If we deny participation at check‑in due to safety concerns you did not disclose in advance, this is treated as a late cancellation (no refund).

If you inform us at least 48 hours prior and we cannot reasonably accommodate, you may receive a full refund or credit.

Abuse, Misconduct, and Prohibited Uses
No refund will be issued if your rental is terminated for:

Operating in closed or restricted areas or in breach of local regulations.

Not wearing a PFD as required.

Reckless behavior, intoxication, or ignoring staff instructions.
-
Carrying prohibited items or exceeding capacity limits.
You may also be liable for associated costs or penalties.
Changes to This Policy
We may update this policy from time to time to reflect operational or legal changes. The version in effect at the time of your booking will apply. The latest version is available on our website.
